LIVE-IN CAREGIVER Employer

Live-in caregivers are individuals who are qualified to work without supervision in a private household providing care for children, elderly persons physically challenged or sick. Many Canadian families are in search of a suitable, qualified Live-in caregiver for home care of such vulnerable family members. Canada is facing a shortage of qualified Canadian caregivers, willing to live in the employer’s homes. There is no shortage of Canadian workers available for caregiving positions where there is no live-in requirement. The Government therefore, allows Canadian families to recruit live-in caregivers from abroad, and issues visa to facilitate their entry into Canada .

Though the processing time varies, usually it takes anywhere between 2-4 months after selection and finalization of employment contract for the caregiver to get the visa for Canada .

 

Employment contract  

The employer and employee are legally required to have a signed contract, which includes the maximum hours of work per week, and the wage rate for those hours of work. The caregiver's duties and responsibilities are set out in the contract to ensure that he/she is aware of the conditions of employment.

 

A contract helps resolve future situations  by protecting rights  as well as providing a clear statement of obligations of both the parties. The contract is also consistent with provincial or territorial labour laws, which establish minimum employment standards such as the minimum wage and overtime payment for additional hours worked.

 

Employers are required to register as an employer with the Canada Revenue Agency (CRA) and remit the monthly deductions for income tax, Employment Insurance and Canada Pension Plan to the proper federal authority. The employer should comply with the law as per instructions received from CRA from time to time; like providing the employee with a record of employment (ROE) when the employee's work term ends.

 

Responsibilities:  

This is a normal employer- employee relationship, governed by employment standards legislation in most provinces and territories. Live-in employees are expected to perform the contracted duties and in turn are entitled to days off each week, statutory holidays, extra pay for overtime work and a salary that meets at least the minimum wage.

 

The employer should provide acceptable working conditions, reasonable duties and fair market wages. The employer is also expected to provide accommodation that ensures privacy, such as a private room with a lock on the door. The caregiver pays rent for a room in employer’s home and is entitled to privacy. The employer should provide the employee with a key to the house to ensure freedom of access. A successful relationship is one which also respects the caregiver's cultural or religious practices and discusses his or her needs.

 

Room and board  

The contract would contain clear information about the amount to be deducted from caregiver’s wages for room and board. These amounts vary as they are governed by the provincial and territorial legislation. E.g. In Ontario, an employer may deduct the following each week for

room and board when the worker is paid minimum wage:

For a private, locked room: $31.70 

For meals: $53.55

 

Room and board charges are generally calculated on a weekly or monthly rate, depending on the terms of the contract. Your employee is entitled to leave your home on days off.
